Perhaps I missed something in the proper chain of proceedings, but from what I have read of this case and the above comments made by yourself, don’t you have a Federal Rules of Civil Procedure Rule 45(b)(2) problem with service on the President? Unless you can identify a time when he will be within 100 miles of the place of the deposition and during that time your process server can get close enough to physically hit him with the subpoena, exactly how do you intend to have him served?

IF (by some miracle) they manage to get proper service on the President, the President’s attorneys are going to immediately make a Rule 45(c)(3)(A)(ii) motion to quash, and I think it is highly likely they’re going to get it BECAUSE it would require the President to travel to a place that is more than 100 miles from the place where that person resides, is employed, or regularly transacts business IN PERSON, AND under Rule 45(c)(3)(B)(iii) it would require a person who is not a party or an officer of a party to incur substantial expense to travel more than 100 miles to attend the trial.

The court can issue the subpoena, but if you can’t have him served, then it’s just theatrics.

P.S- The subpoena in Jones v. Clinton ONLY worked because the President was a NAMED PARTY in the suit. Using that as precedent for subpoenaing the President as a witness isn’t going to work.

Lawsuits, in any decent form, are only used when two parties can’t agree about the distribution of some or other form of energy (be it paychecks, cash, goods, services or even laws). All too often, emotions are involved (”who gets custody of the kids?” and “someone will pay for this!”), they’re almost always self-serving, and it can turn into a screaming-for-attention bout, where the loudest whine wins. Politics is the same thing. We play caustic little emotional games with each other as we try to jostle ahead, and it quickly becomes a fight.

We gotta ditch our Lord of the Flies. We’ve got bigger fish to fry than each other. Our influence on the planet isn’t a theory, it’s a mathematical equation with WE’RE SCREWED IF WE DONT GET READY playing a major part. We’re seriously draining resources. The weather is clearly different than it was only 15 years ago. Earth also lacks decent coverage of the sky – there’s not enough scopes looking out for approaching asteroids. Nuclear fusion would be a good idea, too. And everyone offsetting their waste influences by paying a wee bit extra. There’s a lot we could be doing even right now. I don’t post much, but I felt like giving a rant and venting a little, so I hope you’ll forgive any pedantic tone. Now get out of here, recycle your batteries and pilot your ship.

Jack Thompson is just some guy who wants to be the center of attention, and loves to hear himself talk. He takes controversial and unpopular causes and champions them because he loves to get the headlines. He can’t even resist entering into the flamewars that his antics engender.

My advice for Jack is to start a talk radio show. That’s really where I see you happiest. You could be like a combination of Art Bell and Rush Limbaugh.

There’s no doubt that the President will convince the court of this, because no court operating in the realm of sanity would compel a deposition from the President for this nonsense.

Jack’s just hoping that he can postpone the hearing until January of 2009, on the highly questionable assertion that said deposition is “crucial” to his defense.

Desperate for attention, poor little Jack probably got beat up as a kid and stood up for the prom. Now he’s a lawyer, taking it out on anyone he perceives as more hip or empowered than he is. I guess it will keep him busy for a long time.
