Silicon Knights Responds to Epic Games’ Counterclaim

You may recall the ugly situation between Silicon Knights and Epic Games, which is being sued by the former over the Unreal Engine 3. Since the original filing, Epic has filed a counterclaim and a motion to dismiss Silicon Knights’ case, which Silicon Knights has now ripped apart. That’s about as nicely as I can recap this situation.
Next-Gen got their hands on a September 7 legal filing where Silicon Knights’ team of lawyers picks apart Epic’s counterclaim and motion to dismiss the case. The Epic counterclaim accused Silicon Knights of copyright infringement, breach of contract, misappropriation of trade secrets, and “the imposition of a constructive trust.” Lost yet?
Part of the response to these allegations from Silicon Knights was, “Silicon Knights has… very clearly and sufficiently alleged that Epic has ‘done much wrong.’ Consequently, Epic’s Motion to Dismiss should be denied.”
They also stated, “For Epic to attempt to dispute the merit of those allegations [of the original suit] under the auspices of a motion to dismiss is improper. Therefore, Epic’s Motion to dismiss should be denied in its entirety, Epic should be ordered to answer the Complaint, and this case should proceed to discovery and trial.”
