It’s only strange to the uninitiated. The reason why infringement lawsuits like this aren’t filed until years after the infringing product’s release is so that the claim for damages can be viably larger since the product’s actual sales can be used to substantiate them. So long as the suit is filed within the statute of limitations (usually three years in most U.S. jurisdictions), the delay in filing isn’t a problem and can even be useful with regards to witnesses and paper trails or lack thereof.
